UPDATES FROM THE INDUSTRIAL COURT

Dear ABBOA members,

It has been 5 years now in are quest to seek justice for better benefits both monetary and non-monetary. So far, with the blessing of the Al-Mighty God coupled with full support of all members, we have managed to sail through the rough sea of obstacles and challenges ahead of us.

Looking back, we have gone through with much agony since inception of ABBOA, establishing a trade union, being accorded recognition through Minister Order (an instrumental triumph) and importantly crux of the matter that is the Collective Agreement.

ABBOA presented the Collective Agreement proposal to the Bank in July 2008. However, sadly to say that the Bank disagreed on all the monetary articles during the pasts negotiations. With the Bank stand not to compromise, we had declared deadlock and subsequently filed trade dispute to Human Resource Minister. Within a short span of 2 months, the case was referred to Industrial Court in November 2009.

As you may aware, we have gone through five (5) mentions at the Industrial Court due the Bank have disputed on supporting document in relation to Salary Article. Although the matter is still pending till to date, we managed to convince the Honorable Judge to fix a Hearing Date to avoid further delay.

With Al-Mighty God blessing and prayers from all members, the Court has granted a Hearing Date scheduled on Friday 28th January, 2011 and Monday 31st January, 2011. Even though the Hearing Date is six months from now, that does not mean ABBOA will wait and see. The Honorable Judge has directed both parties and their respective council to narrow down the articles within this cooling period under strict supervision of the Court. The collective bargaining shall take place in the chamber and the Court will advise the date for collective bargaining.

The Honorable Judge has specifically mentioned that only core articles that probably four (4) to five (5) articles out of 36 (36) articles shall be heard during the Hearing Date.

We foresee that the journey to our quest shall be much easier with the ultimate aim to expedite the process of Collection Agreement.

Members are most welcome to give their moral support to ABBOA during the said Hearing Date. For further details, please do not hesitate to call any of the ABBOA Exco.

Your continuous support and cooperation to ABBOA is utmost appreciated.

Warmest Regards

The President
